In order to ensure the proper functioning of public services, the administrative authorities generally have recourse to the imposition of certain disciplinary sanctions on public officials who commit professional misconduct ; which are generally categorized into groups or degrees, but sometimes the disciplinary sanction may be unsuited to the professional misconduct committed, which may infringe the rights and freedoms of employees, and for this reason, the administrative justice has extended its control over the proportion disciplinary sanctions from the decision to the offense committed on the two exaggerated theories ; apparent error.
