يعتبر مجال الترقية العقارية من النشاطات التي كثر فيه الإحتيال على المكتتبين فيه، لا سيما ما شهده الواقع من ممارسات من خلال تطبيق المرسوم 93-03 المتعلق بالنشاط العقاري، لذا تدخل المشرع من خلال القانون 07-11 لتنظيم هذا المجال و ضبطه لكي لا يتعرض المقتنين من احتيالات المتدخلين في إنجاز مشاريع الترقية العقارية.
لقد أقر القانون 11- 04 عدة ضمانات للمكتتب في الترقية العقارية، لا سيما وجوب حصول المرقي على الإعتماد لممارسة الترقية العقارية، و هذا لضبط سجل وطني للمرقيين العقاريين و تطهير القطاع من الدخلاء على هذا النشاط.
Abstract EN
The field of real estate development is one of the activities in which there are many frauds against its subscribers, in particular the practices observed in reality through the application of decree 93-03 relating to the activity.
Law 11-04 established several guarantees for the subscribeds in real estate development, in particular the obligation for the promoter to obtain an agreement to exercise real estate development, and it is a question of setting up a national register of real estate developers and to purify the sector of intruders on this activity.
