Abstract EN

Criminal investigations nowadays focus on digital evidence, given the extensive use of digital technology in criminal activities within the digital space.

One of the main difficulties when dealing with digital evidence is to ensure legal admissibility and its authenticity at the stage of proof before the courts.

As for the level of Islamic jurisprudence, this new type of evidence raises epistemological problems through the process of juris prudential adaptation as well as the attempt to include it within the scope of Islamic jurisprudence.

Moreover, it raises the consequent rulings and effects arising from the contemporary jurisprudential difference about the evidence created in general and the extent of its authority in the Islamic system of evidence.
