This research focuses on the study of the legal status of the private sector in partnership contracts between it and the public sector, highlighting the nature of the partnership contracts concluded between the two sectors, there are those who will say, as having the administrative nature of contracts, and according to another he considers a commercial nature, by law, which is the subject him, as well as the competent court to consider disputes that arise with him.

As this will determine the status of the private sector for the public sector by the balance of the contractual relationship between the parties, it has adopted a large number of developed and developing countries organize partnership contracts between the public and private sectors, because of its importance in achieving economic development through this mechanism.
