تهدف هذه الدارسة إلى تبيان الجهود التشريعية التي كرسها المشرع الجزائري لحماية البيئة في إطار التنمية المستدامة عن طريق إدراج البعد البيئي في التنمية الاقتصادية للمؤسسة الصناعية.
تتجلى النتائج المستوحاة من هذه الدراسة، فرض المشرع الجزائري على نشاط المؤسسة الصناعية نوعين من الرقابة هما : الرقابة الإدارية التي تكون قبل ممارسة المؤسسة الصناعية نشاطها الصناعي عن طريق فرض الرخصة أو التصريح و أثناء ممارسة النشاط الصناعي عن طريق فرض الجزاءات الإدارية، و هناك الرقابة القضائية عن طريق تدخل القضاء المدني و الجزائي لضبط النشاط الملوث للمؤسسة الصناعية باعتبارها الرقابة المكملة للرقابة الإدارية.
Abstract EN
The results inspired by this study show that the Algerian legislator imposed on the activity of the industrial enterprise two types of control, namely administrative control, which is prior to the industrial enterprise's industrial activity by imposing a license or permit and during the practice of industrial activity through the imposition of administrative sanctions, and there is judicial control through the intervention of the civil and criminal judiciary to control the polluting activity of the industrial enterprise as the complementary control of administrative control.
