Prescription is one of the most important issues that raise disagreement in private international law, because of the doctrinal difference over the legal nature of prescription, as it is one of the reasons for the expiration of the obligation without fulfilling it .

accordingly, this research aims to know the law that is applicable to the statute of limitations, as this determination is disputed by two groups, the first assigning it to the law of the judge and the other to the substantive law to determine in the last the position of the Algerian legislator on this dispute.
