أدى تفكيك احتكارات الدولة و فتح قطاعات كاملة من النشاط الاقتصادي و المالي أمام الاستثمار الخاص إلى إنشاء سلطات الضبط المستقلة التي تترجم الانتقال من دولة الرفاهية إلى الدولة الضابطة.
و مع ذلك، فإن نموذج سلطات الضبط المستقلة المستورد من القانون الفرنسي يخضع لتقلبات عميقة يجعله يبتعد تماما عن النموذج الأصلي.
فتجد السلطات الضابطة نفسها في وضعية تبعية مثبتة إزاء السلطة التنفيذية عندما لا يتم تهميشها ببساطة مما يجعلها تؤدي مجرد وظيفة تجميلية.
و عليه يتبين التراجع عن مفهوم الضبط الاقتصادي المستقل الذي يحل محله الضبط الإداري في سياق إحياء الدولة الاستبدادية التي تتصرف بمثابة الوصي على الاقتصادي و المجتمع على حد سواء.
Abstract EN
The dismantling of state monopolies and the opening up of entire sections of economic and financial activity to private investment led to the creation of independent regulatory authorities which marked the transition from the welfare state to the regulatory state.
However, the model of independent regulatory authorities as imported from French law undergoes such a twist that it has only a distant relationship with the structures of origin.
The independent regulatory authorities find themselves in a state of proven dependence on the executive when they are not simply sidelined, so that the formula only serves a decorative function.
We come to the questioning of the notion of independent economic regulation, which is replaced by administrative regulation in the context of the return of the authoritarian State which stands as guardian of both the economic field and society.
Abstract FRE
Le démantèlement des monopoles étatiques et l’ouverture de pans entiers de l’activité économique et financière à l’investissement privé aboutit à la création d’autorités de régulation indépendantes qui marquent le passage de l’Etat providence à l’Etat régulateur.
Toutefois, le modèle des autorités de régulation indépendantes tel qu’importé du droit français subit une torsion telle qu’il n’a plus qu’un lointain rapport avec les structures d’origine.
Les autorités de régulation indépendantes se retrouvent dans un état de dépendance avérée à l’égard du pouvoir exécutif lorsque qu’elles ne sont pas tout simplement mises à l’écart, de sorte que la formule ne remplit plus qu’une fonction décorative.
On en arrive à la remise en cause de la notion de régulation économique indépendante à laquelle se substitue une régulation administrative dans le cadre du retour de l’Etat autoritaire qui s’érige en tuteur tant du champ économique que de la société.
