نظرا للخصائص التي تتميز بها الأضرار التي تصيب البيئة الإنسانية نتيجة للاستغلال السلمي للطاقة النووية رغم أنه يعتبر نشاط غير محظور وفقا لقواعد القانون الدولي، بحيث ينتج عنه أضرارا عابرة للحدود لا تمس فقط مكان وقوع الحادث و إنما تتعدى إلى مناطق أخرى مما يجعلها تتميز بالخطورة الفائقة، أين يتعذر في كثير من الحالات تفعيل قواعد المسؤولية المدنية العادية لعدم قيام أركانها، وذلك من أجل متابعة المسئولين عن تلك الأضرار و إلزامهم بالتعويض عنها، مما يستلزم الأمر على المشرع الدولي البحث عن نظام قانوني استثنائي للمسؤولية المدنية العادية ألا و هو نظام المسؤولية الموضوعية، الذي من شأنه ضمان حماية البيئة و توفير أكثر فرص للحصول على التعويض الملائم عند وقوع مثل هذه الكوارث البيئية الناجمة عن الاستغلال السلمي للطاقة النووية.
Abstract EN
Given the characteristics of the damage to the human environment as a result of the peaceful exploitation of nuclear energy, which is not prohibited in accordance with the rules of international law, resulting in cross boundary damage not only affecting the place of damage, or beyond to other areas, causing very serious damage many cases activate normal civil liability rules to follow up on those responsible and compel them to compensate for those damage, which necessitated the international legislator to search for an exceptional liability law system, an objective liability regime that would ensure the protection of the environment and provide more access to adequate compensation for those affected in the event of such environmental disasters resulting from the peaceful exploitation of nuclear energy.

Considérant les caractéristiques des dommages causés a l’environnement humain résultant de l’exploitation pacifique de l’énergie nucléaire, qui n’est pas interdite conformément aux règles du droit international, entrainant des dommages transfrontières n’affectant pas seulement le lien du l’incident ou au-delà causant des dommages très graves, dans nombreux cas il est impossible d’activer les règles de responsabilité civile ordinaire en cas de défaillance de son personnel afin d’assurer le suivi des responsables et les obliger a réparer ces dommages, ce qui a obligé le législateur international a rechercher un système de responsabilité objective qui garantisse la protection de l’environnement et offre davantage de possibilité de réparation appropriée pour les personnes touchées en cas de telles catastrophes environnementales causée par l’exploitation pacifique de l’énergie nucléaire.
