يعتبر حق الإنسان في بيئة سليمة من بين أهم المطالب التي تقوم عليها عجلة التنمية في ظل التلوث البيئي الكبير الذي تعاني منه الكرة الأرضية و الذي نجم عنه مشاكل جمة، لذا توالت الجهود الدولية و الداخلية للحفاظ على البيئة باعتبارها من بين أهم حقوق التضامن التي يقوم عليها الجيل الثالث من حقوق الإنسان، لذا أصبح تضمين هذا الحق في الدستور أمرا حتميا، و هو ما سارت عليه الجزائر في آخر تعديل دستوري لسنة 2016 باعتباره خيار استراتيجي و ضرورة قانونية من أجل تكريس أسمى حماية للبيئة، و من بين ضمانات تكريس الحق في بيئة سليمة في الدستور الاعتراف للقاضي بتكريس الأمن القانوني باعتباره الحامي الحقيقي للحقوق و الحريات حسب المادة 157 من الدستور و خاصة القاضي الإداري الذي يملك سلطات واسعة في مواجهة الإدارة من أجل حماية الحق في البيئة سواء من حيث إلغاء القرارات البيئية غير مشروعة أو غير ملائمة، أو عن طريق جبر الأضرار البيئية.
Abstract EN
The right to a healthy environment is regarded as a basic human right in sustainable development and is protected by law.
Under the large environmental pollution that the globe suffering from, and that caused major problems, many international and domestic efforts come up to protect the environment as one of the most important rights of solidarity the third generation of human rights.
The inclusion of this right in the Constitution is inevitable, which Algeria pursued in the last constitutional amendment of 2016 as a strategic choice and a legal necessity in order to establish its highest legal protection.
Devote security According to Article 157 of the Constitution, especially the administrative judge who has broad powers in the face of the administration to protect the right to the environment, in terms of the cancellation of illegal or inappropriate environmental decisions, or through reparation of environmental damage.

Le droit à un environnement sain est considéré comme un droit humain fondamental dans le développement durable protégé par la loi.
Face à la grande pollution dont souffre le globe terrestre et qui a causé des problèmes majeurs, de nombreux efforts internationaux et nationaux sont déployés afin de protéger l'environnement comme l'un des droits de solidarité les plus importants de la troisième génération des droits de l'homme.
La Constitutionnalisation de ce droit est impérative, c'est ce qu'a fait l'Algérie dans l'amendement constitutionnel de 2016 comme un choix stratégique et une nécessité juridique afin d'établir sa plus haute protection juridique.
Parmi les garanties de la consécration du droit à un environnement sain, on trouve en particulier les larges pouvoirs conférés au juge administratif face à l’administration par l’article 157 de la constitution, pour protéger le droit à l'environnement, notamment en matière d'annulation des décisions environnementales illégales ou inappropriées, et matière de la réparation des dommages environnementaux.
