The emergence of electronic crime has raised in a significant and worrying way several problems in the field of criminal law, due to the difficulty or impossibility of applying the traditional investigative procedures granted to the judicial police for the detection.

L'émergence de la criminalité électronique a soulevé de manière significative et inquiétante plusieurs problèmes dans le domaine du droit pénal, en raison de la difficulté ou de l'impossibilité d'appliquer les procédures d'enquête traditionnelles accordées à la police judiciaire pour la détection des crimes en général.

Le législateur algérien a développé des règles procédurales particulières pendant l'enquête, compatibles avec les caractéristiques de la criminalité électronique, et en même temps qu’il a modernisé les mécanismes traditionnels pour la détection du crime.

Malgré la nécessité de recourir à des méthodes d'enquête spéciales liées à la cybercriminalité, leur application souffre d'un certain nombre d'obstacles qui limitent leur efficacité, en raison de leur préjudice aux intérêts des personnes concernées.
