حرصا من المشرع الجزائري على حماية الأموال العامة و الخاصة الموضوعة تحت يد الموظف العام بسبب وظيفته أو بمقتضاها لم يجرم فقط الاعتداء العمدي من طرف هذا الأخير عليها، و إنما جرم أيضا الاعتداء غير العمدي، و يتجسد ذلك من خلال تجريمه لفعل الإهمال في التسيير أو ما يعرف بجريمة الإهمال الواضح.
و يثير موضوع جريمة الإهمال الواضح العديد من الإشكاليات القانونية، تتعلق أساسا بمدى نجاعة السياسة الجنائية التي انتهجها المشرع لمواجهة هذه الجريمة و الحد منها.
و لقد حاولنا من خلال دراستنا لهذا الموضوع مناقشة الإشكالية المطروحة، و اقتراح حلول لها.
Abstract EN
In the interest of the Algerian legislator to protect public and private funds placed under the hands of the public official because of his job or pursuant to it, he not only criminalizes intentional aggression by the latter, but also criminalizes unintentional aggression, and this is embodied through his criminalization of the act of negligence in the management or what is known as the crime of negligence It is clear, according to Article 119 bis of the Penal Code.
The issue of the crime of clear negligence raises many legal problems related mainly to the effectiveness of the criminal policy that the legislator adopted to confront this crime and reduce it.
Through our study of this subject, we have tried to discuss these problems and suggest appropriate solutions to them.

Le législateur algérien tient à protéger les deniers publics et privés placés entre les mains du fonctionnaire public en raison de son emploi, et en vertu duquel il a non seulement criminalisé l'agression intentionnelle de ce dernier, mais criminalise également l'agression non intentionnelle et cela se traduit par la criminalisation de l'acte de négligence manifeste, selon l'article 119 bis du code pénal.
L'infraction de négligence manifeste soulève de nombreux problèmes juridiques principalement, en ce qui concerne l'efficacité de la politique pénale adoptée par le législateur pour faire face et limiter l'infraction.
Grâce à notre étude de ce sujet, nous avons essayé de discuter du problème et proposer des solutions.
