إن موضوع مضيق هرمز ليس من الموضوعات الجديدة التي طرحت على الساحة الدولية، ولكن الجديد فيه هو موضوع احتجاز السفن الذي حصل في المضيق في الآونة الأخيرة من قبل الدول المطلة عليه فسرعان ما بدأت النقاشات القانونية حول صحة احتجاز السفن المارة عبر هذا المضيق ضمن ما يسمى المرور العابر أو البريء.
فقد كفلت جميع المواثيق الدولية هذا الحق، وأعطت الدول الشاطئية صلاحيات وواجبات تصب جميعها في خانة واحدة وهي تيسير وتنظيم المرور الآمن للسفن، بغض النظر عن جنسية هذه السفن وانطلاقا من المفهوم القانوني وتحديدا القانون الدولي نجد أن الاتفاقيات الدولية جميعها عبر مختلف العصور كانت واضحة تماما في عدم السماح لأي دولة باحتجاز السفن المارة عبر المضائق الدولية، أو حتى مجرد التهديد بعدم السماح لها بالمرور الأمن عبر المضائق الدولية المختلفة، بإشارة إلى حق المرور استنادا للمواثيق الدولية المختلفة التي سعت منظمة الأمم المتحدة إلى ترسيخها والعمل بمقتضاها.
لذا فمن المفيد تسليط الضوء على الإطار العام لمضيق هرمز في القانون الدولي العام والنصوص القانونية المنظمة للمضيق والصلاحيات الممنوحة للدول الشاطئية للمضيق، ومدى قانونية احتجاز السفن التي تعبر ضمن مفهوم المرور العابر، وذلك من خلال التطرق لتفاصيل النصوص القانونية المتعلقة بالاتفاقيات الدولية المعنية بهذا الموضوع وتحديدا اتفاقية الأمم المتحدة لقانون البحار لعام ۱۹۸۲م.
كما تم سرد للعديد من الاحتجازات للسفن التي حصلت عبر مختلف العصور وصولا إلى يومنا هذا.
Abstract EN
The issue of the strait of Hormuz is not one of the new issues that have been raised on the international scene, but what is new in it is the issue of the recent abuses in the strait by one of the countries bordering it.
legal debates over the validity of the detention of ships passing through the strait soon began within so-called transit or innocent traffic.
all international conventions have ensured this right, and onshore states have given powers and duties all in one box: facilitating and regulating the safe passage of ships, regardless of the nationality of such vessel.
based on our legal concept, namely international law, all international conventions throughout the ages have been very clear in not allowing any country to detain ships passing through international straits.
it is therefore useful to highlight the legal provisions governing the strait, the powers granted to the coastal states of the strait, and the legality of the detention of ships crossing the strait within the concept of transit.
therefore, it is useful to shed light on the general framework of the strait of Hormuz in public international law, the legal texts organizing the strait and the powers granted to the coastal states of the strait, and the extent of the legality of the detention of ships that cross within the concept of transit, by examining the details of legal texts related to international conventions on this subject and specifically an agreement united nations, the law of the sea, 1982.
also listed are many of the ship holdings that took place throughout the various ages up to the present day.
