This study aims to discuss the issue of the impact of disability on the emergence of the marriage bond or its dissolution with respect to both sexes, and we have adopted a survey on the positions of jurists of Islamic law and legal legislations that dealt with the issue, and a discussion of opinions and evidence and the weighting between them, ending with contemporary view and modern trends.

one of the most important research findings is that sharia law allowed the dissolution of the contract with flaws that allow the dissolution of the marriage, and the sovereign settles the matter and preserves the rights.

as for the laws, most allow marriage for people with special needs under specific conditions within the framework of the consent of the other party and preserving their rights.
