The system of referral to the Dispute Tribunal is considered as a legal means, used to solve the problems which are the results of distribution of jurisdiction between administrative jurisdictions and ordinary courts.

This system is characterized in its authorization to these courts itself to trigger the action directly before the court of conflicts.

the court concerned will pronounce that effect a decision which will not be subject to any remedy.

The Algerian legislator has demanded conditions and a procedure for the referral to the court in the conflict court.

However, these conditions in its majority, on the one hand, it has many nuances.

This procedure is also overlapping with the procedure of conflicting judges, despite the many differences between the conflict between the judges and the conflict of jurisdictions belonging to the two judicial systems (administrative and judicial).
