لقد كرس المشرع الجزائري العديد من النصوص القانونية التي تجسد الاستثمار في الأنشطة الاقتصادية، لكن هذه الأنشطة يمكن أن يكون لها دور سلبي على البيئة، مما يجعل من تكريس حماية فعالة لهذه الأخيرة أمر لابد منه، وذلك من خلال التوفيق بين الاستثمار من جهة وتحقيق الحماية للبيئة لتجسيد التنمية المستدامة من جهة أخرى، الأمر الذي أدى لصدور القانون رقم 83-03 المتعلق بحماية البيئة، بالإضافة إلى قوانين الاستثمار المتعاقبة آخرها القانون رقم 16-09 المتعلق بترقية الاستثمار، كما نجد تجسيد عدة مبادئ وضوابط لحماية البيئة في إطار الاستثمار في الأنشطة الاقتصادية.
Abstract EN
The Algerian legislator has devoted many legal texts that embody investment in economic activities, but these activities can have a negative role on the environment, which makes devoting effective protection to the latter is a must, by reconciling investment on the one hand and achieving protection for the environment to embody sustainable development on the other hand; that what led to issuing law n° 83 03 related to environment protection investment in addition to investment successive laws; the latest of which was that n° 16 09 of investment promotion.
we also find the embodiment of several principles and controls to protect the environment within the framework of investment in economic activities.
