يعتبر تقادم الدعاوى الناشئة عن عقد التأمين سببا من أسباب انقضائه، ولقد أحاطه المشرع الجزائري على غرار المشرع الفرنسي بقواعد خاصة سواءا كان ذلك في القانون المدني أو في الأمر المتعلق بالتأمينات.
تهدف هذه الورقة البحثية إلى تسليط الضوء على الأحكام الخاصة بتقادم الدعاوى الناشئة عن عقد التأمين في التشريعين الجزائري والفرنسي.
Abstract EN
The limitation of actions due to the insurance contract is among the reasons for its expiration.
the Algerian legislator framed it by special rules that it is in the civil law or in the relative ordinance of the insurances.
this article aims to clarify the various provisions concerning the prescription of actions due to the insurance contract in the two Algerian and French legislations.
