Abstract EN

This article aims to clarify the provision of Hajj stay in Tashriq Nights outside Mina if there is no place in it.

It collects the Sharia evidence and scholars’ opinions, discussing and analyzing them and concludes with the following findings: 1.

Stay in Mina is necessary only for those who afford it.

2.

Prophet Mohammed (PBUH) allows bartenders and shepherds to leave stay in Mina and that can be extended to all those with excuses.

3.

Any Haj who does not find a place in Mina is prior to those mentioned by Shafi’i scholars that excuse is not limited to bartenders and shepherds.

4.

Any Hajj who does not find a place in Mina can stay where he wants.

5.

If Mina Mosque is filled, it means Mina is filled, and tents should be connected in rows like those in mosque after Imam.
