Abstract EN

This article aims to examine the reasons of conflict among jurisprudence scholars on pilgrimage issues.

It starts by an overview of the most important reasons of such a conflict in general, by first tackling the reasons of conflict among the Prophet’s (Mohammed) companions then it goes over the reasons of conflict among other jurisprudence scholars.

The article thereafter exemplifies the conflict based on some of pilgrimage issues.

The study concludes that the most important reasons of conflict specifically in relation to the pilgrimage issues are those related to the Holy Qur’an, Hadith attainment and confirmation, and the difficulty of understanding the text and its interpretation.

It is also due to the difference in some rules related to the significance of the texts on provisions, the difference in the authenticity of some evidence, the conflict between evidence, the difference in judgement when there is no text in the matter under question, and the difference in some rules and principles of jurisprudence.
