Abstract EN

This article aims to study ibn Bayyeh’s vision on paying off deferred debts in times of inflation.

inflation has disastrous effects on societies, and hence receiving much research and investigation in a number of researches and conferences so as to provide sharia solutions to overcome its risks.

the problem of the study lies in that inflation books do not address sharia provisions on who causes it intentionally or unintentionally, especially mentioning wars as a cause of inflation.

wars cause severe crises like killing, famines, loss of currency value, which in turn cause many corruptions and harms.

thus, in this article the researcher presents an account of previous jurisprudence perspectives, decisions of jurisprudential consensus and above all ibn Bayyeh’s work on this aspect.

the researcher also identifies the duplication of Alkuraim’s dealings in transferring money from Aden to Sana'a and vice versa, addressing what the causer should do and supporting all that with jurisprudential principles and foundationalists’ opinions.

the study employs the adaptative approach, eliciting the materials from jurisprudential books.

it concludes that the fatwa for paying off the deferred debts in the times of inflation does not provide a solution to this issue.

the causer of inflation should bear all the consequences of his behavior.

researchers should understand the contemporary issues when trying to solve these issues so that sharia provisions be comprehensive, even relatively, including all or parts of these issues.
