Abstract EN

This article aims to tackle an important aspect of foundations of jurisprudence, viz.

inference outside dispute.

The importance of this topic lies in who does the criticism, i.e.

the jurisprudence scholar, Alamidi, and the book under study is “Alihkam fi Usul Alahkam”, one of the best books in this regard.

The researcher exerts great efforts in pinpointing Alamidi’s foundational criticism approach, which is based on a correct scientific approach, giving all reasons possible that these inferences cannot be taken for granted as they are outside dispute.

The study consists of two sections, a conclusion and references.

It introduces Alamidi, his approach, terminology, etc.

The most important findings of the study are: highlighting Amidi’s foundational criticism approach in terms of criticizing the definitions, identifying positions of dispute criticizing the approach followed and preferences.

The study also contains some models of criticism made use of by Alamidi which were provided by some foundational scholars as being outside dispute and thus not recommended to be used as references.
