Abstract EN

This article aims to shed light on jurisprudential provisions elicited from the chapter “Fetus blood money”.

Sharia has provided an exceptional solicitude for the human being, strong caring that no other religion has ever given.

It is evidence to the perfection of the Sharia.

It supports the fact that the human being is heavenly divine, and not a creation of the imperfect humans both in minds and in judgments.

An example of the Sharia’s solicitude for the human being is the respect given to the fetus in its mother’s womb.

It is forbidden to abuse the mother or the fetus, to cause harm or to end the fetus’s life.

This is all reflected through Allah’s provisions, in that the attacker must face the consequences for the harm caused.

The attacker has to pay the blood money and Kaffarah (expiation) to the victim according to the offense that has been committed.

This is what I have indicated in this study with clarifying some of the modern issues related to the topic in question.
