Arabic Abstract

بعد عقد الاعتماد المستندي من أهم وسائل التجارة الخارجية التي يلجأ له التجار لما يتمتع به من ضمانات ومميزات، وقد تطرقت هذه الرسالة إلى موضوع تعديل عقد الاعتماد المستندي وجاءت بعنوان تعديل عقد الاعتماد المستندي وقد جاءت هذه الرسالة بفصلين تناولت في الفصل الأول ماهية عقد الاعتماد المستندي وأهميته وما يتمتع به من خصائص وتناولت أيضاً إجراءات فتح عقد الاعتماد المستندي والعلاقات القانونية التي تنشأ عنه وطبيعتها والتزامات أطرافه وتناولت أخيراً أبرز أنواع الإعتمادات المستندية، أما الفصل الثاني فقد تناولت فيه مفهوم تعديل عقد الاعتماد المستندي والغاية من تعديله وما يترتب عنه من أثار وتناولت أبرز حالات تعديل عقد الاعتماد المستندي وإجراءات تعديله ودور كل طرف من أطراف عقد الاعتماد المستندي في التعديل.

وقد خلصت الدراسة إلى أن الغاية الاساسية من تعديل عقد الاعتماد المستندي المحافظة على مصالح أطراف الإعتماد واستمرار العلاقة التعاقدية بينهم وأيضاً خلصت إلى أن المشرع الأردني لم يعالج تعديل عقد الاعتماد المستندي في نصوصه بل اكتفى بتطبيق القواعد والأعراف الموحدة هو إن النشرة الدولية 600 لعام 2007 الصادرة عن غرفة التجارة الدولية أشارت إلى تعديل عقد الاعتماد المستندي في المادة 10 بشكل مقتضب ولم توضح بشكل ينتفي معه اللبس والغموض حول تعديل عقد الاعتماد المستندي كان على غرفة التجارة الدولية إعطاء موضوع تعديل عقد الاعتماد المستندي قدراً كافياً من التوضيح.

English Abstract

Documentary credit is one of the most important means of foreign trades that trader’s resort to and use because of the guarantees and advantages it contains.

In my research I talked about the subject the amendment documentary credit and came under the title of amending the documentary credit.

This research came with two chapters, chapter one dealt with the nature of the documentary credit, its importance, characteristics, the procedures for opening the documentary credit, the legal relations that arise, the obligations of its parties and finally dealt with the most prominent types Documentary Credits.

In the second chapter, I dealt with concept of amendment of the documentary credit, the purpose of amendment, consequences, the most prominent cases, the procedures for amending and the role of each party.

This research concluded that the major aim of amending is to keep interests of all parties and contractual relationship between them.

It also concluded that the Jordanian legislator did not deal with the amendment of the documentary credit in its texts, but applied the standard rules and customs.

The International Bulletin 600 for the year 2007 issued by the International Chamber of Commerce referred to the amendment of the documentary credit contract in Article 10 in a brief manner and did not explain in a way that eliminates ambiguity and ambiguity about the amendment of the documentary credit.
