Arabic Abstract

تبحث هذه الدراسة في موضوع، أثر العدول عن الخطبة وتطبيقاته في المحاكم الشرعية الأردنية و الكويتية و هي من المواضيع التي تتعلق بالأحكام الشرعية ذات الصلة بالأحوال الشخصية، و قد اتبعت الدراسة المنهج الوصفي التحليلي، و المنهج المقارن في عرض المسائل الفقهية و قد جاءت هذه الدراسة في تمهيد و أربعة فصول و خاتمة، أما التمهيد فيتحدث عن محتويات الدراسة.

و تناول الفصل الأول، المقدمة، و مشكلة الدراسة، و المنهجية المتبعة، و أهداف البحث.

أما الفصل الثاني، ففي مفهوم الخطبة و تكييفها الفقهي و القانوني و تناول مفهوم الخطبة في قانون الأحوال الشخصية الأردني و الكويتي، و التكييف الفقهي و القانوني للخطبة و الفصل الثالث، تناول العدول عن الخطبة و الأثر المترتب عليه في الفقه و القانون الأردني و الكويتي، و مواطن الاتفاق و الاختلاف بينهما.

و في الفصل الرابع و الأخير، تطبيقات العدول عن الخطبة في المحاكم الشرعية الأردنية و الكويتية.

English Abstract

Study this study on the topic, the effect of abandoning the Jordanian and Kuwaiti sermon, and it is one of the topics related to the provisions related to the topic, and the study was followed on the topic of the descriptive, analytical approach, and the comparative approach in presenting the jurisprudential comparison.

The study was in an introduction, and four chapters, while this study was part of the backup copy.

The first deals with the introduction, the problem of the study, the methodology used, and the objectives of the research.

As for the second chapter, it deals with the concept of the sermon and its jurisprudential and legal adaptation, and it deals with the concept of sermon in the Jordanian and Kuwaiti personal status law, and the jurisprudential and legal adaptation of the sermon.

The third principle deals with the abstinence from the engagement and the impact it has in the Jordanian and Kuwaiti law and jurisprudence, and the areas of agreement and the difference between them.

And in the fourth and final chapter, the applications of abstaining from engagement in the Jordanian and Kuwaiti Sharia courts.
