Arabic Abstract

تهدف هذه الدراسة إلى التعرف على الدعوى الصورية في المحاكم الشرعية الأردنية، من خلال بيان مفهوم الدعوى الصورية و أثرها و حكمها و تفريقها عن الدعوى الكيدية، و بيان كيف تعاملت الشريعة الإسلامية و المحاكم الشرعية مع الدعاوى الصورية و بيان النصوص التي تحرمها و موقف الفقهاء منها، و موقف قانون الأحوال الشخصية الأردني، و قانون أصول المحاكمات الشرعي الأردني، و مجلة الأحكام العدلية و القضاة و المحامين منها.

ثم اشتملت هذه الدراسة على طرق إثبات و الكشف عن الدعاوى الصورية، و بيان مصير الدعوى الصورية في المحاكم الشرعية، و بيان الأهداف و الأسباب الدافعة على الدعاوى الصورية، و الأضرار الناتجة عنها و طرق الحد منها، و اشتملت أيضًا على نماذج متنوعة على الدعاوى الصورية منها ؛ ما هو مختص بالمال، و منها ما هو مختص بغير المال، و توضيحها و التعليق عليها.

و من أبرز ما توصلت إليه الدراسة إثبات حرمة الدعاوى الصورية التي لا يوجد فيها خصومة حقيقية بين المدعي و المُدَّعَى عليه، و أحقية الاعتراض عليها من المتضرر منها، و مصيرها في المحاكم الشرعية الأردنية، و طرق كشفها و الحد منها.

English Abstract

This study aims at identifying the fictitious case in the Jordanian Juridical courts, by explaining the concept of the fictitious case, its impact, ruling, and differentiating it from the swindle lawsuit, and explaining how the Islamic Sharia and Juridical courts dealt with fictitious cases, and the texts which prohibit them, then the attitude of the jurists thereof, and the attitude of the Jordanian Personal Status Law, the Jordanian Sharia Principles of Trial Law, the judicial verdicts magazine, judges and lawyers thereof.

This study included methods of proving and uncovering fictitious cases, clarifying the fate of the fictitious case in the Sharia courts, explaining the objectives and reasons behind the fictitious cases, the resulting damages and ways to reduce them.

It also included various models on fictitious cases, whether concerned with money or not, to explain them and commenting on them.

Among the most prominent findings of the study is the proof of the prohibition of fictitious cases in which there is no real dispute between the plaintiff and the defendant, the right to object to them from the harmed party, their fate in the Jordanian Juridical courts, and methods of detection and limitation.
