Arabic Abstract

هدفت هذه الدراسة إلى إبراز مسؤولية الموظف العام الناشئة عن مخالفة التزامها بتنفيذ الأحكام القضائية، إضافةً إلى توضيح الإطار القانوني الذي يحكم تنفيذ الأحكام القضائية، بيان الأسباب التي أدت إلى امتناع الموظف العام عن التنفيذ، و تحديد المسؤولية المترتبة على الامتناع عن تنفيذ الأحكام القضائية في القانون العراقي و الأردني من خلال استخدام المنهج الوصفي و التحليلي و المنهم المقارن.

و قد توصلت الدراسة إلى إن مسألة تنفيذ الأحكام القضائية الإدارية لا تزال تواجه صعوبات في تنفيذ تلك الأحكام و يرجع سبب ذلك إلى استقلال الإدارة في مواجهة القضاء الإداري من جهة، وعدم قدرة توجيه أوامر من القاضي الإداري إلى الإدارة من جهة أخرى، بالإضافة إلى ذلك لا يجوز الحجز على أموال الإدارة بسبب الحماية المخصصة للأموال العامة، و إن امتناع الإدارة عن طريق موظفيها عن تنفيذ أحكام القضاء يشكل خطا مرفقياً تكون الإدارة مسؤولة بموجبه ، كما يعد في الوقت نفسه خطأ شخصياً يقع على عائق المسؤول المباشر عن التنفيذ نظراً إلى ما ينطوي عليه هذا الامتناع من خطأ جسيم واعتداء على قوة الشيء المقضي به، و من ثم تكون الإدارة والموظف مسؤولين عن دفع التعويض للمتضرر، و أخيراً أوصت بإزالة القصور الذي تميزت به الوسائل التقليدية لإلزام الإدارة على احترام الأمر المقضي به و إصرارها رفض تنفيذ القرارات الإدارية الصادرة عنها، لذلك ندعو المشرع العراقي إلى التدخل مقتدياً بالحل الذي أوجده المشرع الفرنسي بمنح القاضي الذي ينظر في الدعوى الوسيلة التي تمكنه من كفالة تنفيذ القرارات القضائية الإدارية الصادرة عنه ضد الإدارة.

English Abstract

This study aimed to highlight the responsibility of the public employee arising from the violation of its obligation to implement judicial rulings, in addition to clarifying the legal framework that governs the implementation of judicial rulings, stating the reasons that led to the public employee’s refusal to implement, and determining the responsibility resulting from refraining from implementing judicial rulings in Iraqi law And the Jordanian through the use of the descriptive, analytical and comparative approach.

The study concluded that the issue of implementing administrative judicial rulings still faces difficulties in implementing those rulings.

The reason for this is due to the independence of the administration in the face of the administrative judiciary on the one hand, and the inability to direct orders from the administrative judge to the administration on the other hand, in addition, it is not permissible to seize On the administration’s funds because of the protection allocated to public funds, and that the administration’s refusal through its employees to implement the court rulings constitutes an attachment error for which the administration is responsible, and at the same time it is a personal error that falls on the shoulders of the person directly responsible for the implementation given the error involved in this abstention serious and an assault on the power of the res judicata, and then the administration and the employee are responsible for paying compensation to the aggrieved, and finally recommended By removing the shortcomings that characterized the traditional means of compelling the administration to respect the order and its insistence on refusing to implement the administrative decisions issued by it.

Therefore, we call on the Iraqi legislator to intervene, imitating the solution created by the French legislator by granting the judge examining the case the means to ensure the implementation of judicial decisions Administrative issued against the administration.
