Arabic Abstract

تناولت هذه الدراسة بيان الطبيعة القانونية للقرارات الصادرة عن النقابات المهنية من وجهة نظر الفقه و القضاء في الأردن و مصر، و خلصت هذه الدراسة إلى أن القرارات الصادرة عن النقابات المهنية تنقسم إلى قسمين، فالقسم الأول هي قرارات يطعن بها أمام القضاء الإداري، و القسم الثاني هي قرارات لا يطعن بها أمام القضاء الإداري، و هذا حسب ما ورد في نصوص قوانين هذه النقابات، أما من ناحية الطبيعة القانونية أو التكييف للنقابات المهنية، هنا لم يبين التشريع هذه الطبيعة أو التكييف لكن حاول القضاء أن يبين هذه الطبيعة، فجزء منه اعتبر النقابات المهنية من أشخاص القانون العام، و جزء آخر اعتبرها شخص من أشخاص القانون الخاص، و من أبرز ما توصلنا له من خلال هذه الدراسة توصلنا إلى ان قرارت النقابات المهنية لا تعتبر قرارت إدارية حتى لو يطعن بها أمام القضاء الإداري ؛ لأن قرارات النقابات المهنية لا تمتلك جميع خصائص القرار القانوني الإداري.

و قد جاءت هذه الدراسة في مبحث تمهيدي و فصلين، أمَّا التمهيد فيتحدث عن مفهوم ونشأة النقابات المهنية، و تناول الفصل الأول التكييف القانوني للنقابات المهنية و مفوم هذه القرارات، و تناول الفصل الثاني الرقابة القضائية على قرارات النقابات المهنية.

English Abstract

This study deals with a statement of the legal nature of decisions issued by professional unions from the point of view of jurisprudence and the judiciary in Jordan and Egypt, and this study concluded that the decisions issued by the professional unions are divided into two parts: The first section are administrative decisions that are challenged before the administrative judiciary, and the second section are decisions that cannot be challenged before the administrative judiciary, and this is according to the texts of the laws of these unions, As for the legal nature of professional unions here, the legislation did not indicate this nature, but the judiciary tried to clarify this nature, as part of it considered professional trade unions as a person of public law and another part considered it a person of private law, Among the most prominent of what we have reached through this study we have concluded that the decisions of professional associations are not considered administrative decisions even if they are challenged before the administrative court because the decisions of the unions do not possess all the characteristics of the administrative decision This study came in an introductory study and two chapters, as for the introduction, it talks about the concept and emergence of professional syndicates, and the first chapter deals with the legal nature of professional unions, and the second chapter states judicial oversight of the decisions of professional syndicates.
