تتمتع السلطة الاداریة فی مجال القانون العام بعدة امتیازات و منها التنفیذ المباشر للقرار الإداری القائم على تنفیذ الادارة المباشر لقراراتها المشروعة و من دون اللجوء إلى القضاء للحصول على حكم بذلك وأن لجوء الادارة للتنفیذ المباشر یرتب علیه الآثار القانونیة وذلك من خلال احداث تغییر أو تعدیل فی المراكز القانونیة القائمة وقت التنفیذ خاصة أنه یعتبر عملا انفرادیا من جانب الادارة مما یقتضی معه ربطه بالغایة التی تسعى الى تحقیقها السلطة الاداریة.
و بالهدف الذی منحت من أجله التنفیذ المباشر و كذلك الالتزام بالقیود و الاجراءات الواجبة علیها الالتزام بها سواء عند اتخاذ القرار الخاضع للتنفیذ المباشر أو عند اتباعها الاجراءات اللازمة فی التنفیذ المباشر للقرار الذی اتخذته الادارة مسبقا، إذ أنه یعد حق الادارة فی التنفیذ المباشر للقرار الإداری استثناء على القاعدة العامة و التی یكون بمقتضاها بالنسبة للإدارة و الأفراد على السواء ضرورة الالتجاء إلى القضاء فی حالة المنازعة، خاصة أن العملیة الاداریة تسعى دائما إلى تحقیق الصالح العام للمجتمع وأن القرارات التی تتخذها الادارة تسعى إلى تحقیق هدف معین وأن الإدارة بالتنفیذ المباشر تتفادى بذلك الهدف ما قد یحدث للمجتمع من اضرار كون أنه امتیاز معزز للإدارة وذلك لأنه نابع من فكرة السلطة التی تتمیز بها الادارة عن الافراد.
و بالتالی فإن خروج الادارة عن تلك الحدود یؤدی بها إلى تحقیق مسؤولیتها القانونیة و یصبح عملها غیر مشروع و هذا بدوره یؤدی إلى ترتیب آثار تعمل على تهدید مصالح الأفراد و الذی ینتج عنه زعزعة للثقة ما بین الادارة و الافراد.
Abstract EN
The direct execution of administrative decisions is an important principle in the administrative law to ensure the functioning of public facilities .
This power of direct execution of administrative decisions is defined as (the right of the administration to implement its decisions by itself forcibly without resorting to the judiciary).
This privilege of direct implementation is not a goal in itself, it is a means for the administration to be able to carry out its duties .
The research hypothesis is that when the administration enjoys the privilege of direct execution, it has its legitimate core.
However, it is a dangerous privilege when it is misused by the administration.
The aim of this research is to discuss the mechanisms followed by the administration to maintain the legitimacy of the direct execution of its decisions.
if the administration misused the power granted would be legal responsible for its actions, and this could result in a destabilization of trust between the administration and individuals
