Abstract EN

Praise be to God, and prayers and peace be upon the Prophet Muhammad..., This is a research study on: disciplinary fines in Islamic law, a comparative study based on the rules of Usul al-Fiqh; I researched in it the definition of punitiveness and money, linguistically and idiomatically, and the disputes of the jurists regarding the ruling of punitiveness by taking money, and the evidence for each saying, then choosing the right side between them.

The research was organized in the following plan: The first Chapter: I wrote the subject of the dispute in the matter The second chapter: I mentioned the sayings on the issue, which are two statements: absolute permissibility, and absolute prohibition.

The third chapter: I mentioned the evidence of the authorized, and the evidence of the impediments.

The Fourth chapter: I mentioned the most correct among the sayings.

Conclusion :In it the most important results and recommendations were mentioned.
