Abstract EN

This paper deals with the subject of public freedoms and the ensuing problems mainly related to the exercise of these freedoms in exceptional circumstances, where the Constitution, international treaties and laws guarantee the protection of public freedoms, but the exercise of some of these freedoms can be restricted if necessary in the case of exceptional circumstances, as is the case with the emerging COV pandemic, which prompted the State to take firm action under which certain freedoms were conditionally restricted.

The study and analysis also address the concept of administrative control and the discretion and discretion in the protection of public freedoms in the light of the emerging COV pandemic, reviewing some of the legal texts issued in this purpose, which dealt with the subject of freedoms as well as the actions taken by the Algerian State under this pandemic, which came in line with the development of the epidemiological situation at the national level, to conclude that the actions taken were highly balanced with the development of the pandemic, although it directly affected the rights and freedoms of the citizen.
