The civil service sector in all countries, including Algeria, is one of the most important sectors on which the State's activities in various fields and areas depend, especially with regard to the management of public utilities.

perhaps one of the most important pillars of the public service is public officials, who are the principal instrument through which the State can carry out its functions and achieve its objectives, and upon whom the good and orderly functioning of public utilities depends.

this importance has made the defintion of a public official and the adaptation of the legal relationship between the public employee and the administration one of the most controversial topics between jurisprudence and the administrative judiciary, although most of the legislation of the world's public service, including Algeria, has agreed that the description of a public official depends on four conditions, namely, appointment, durability of the post, service in a public facility and demarcation, and has introduced organizational or regulatory theory in adapting the legal relationship between the public employee and the administration.
