Islamic shari'a came step forward in maintaining women's rights especially the matter of wife inheritance from the missing person, which considered it an sacrosanct right because of almighty god judgment, that was organized by Algerian family law in its texts pursuant to what the shari'a said, but this initiative remains limited effectiveness in reason of their sufficiently lack organization, so this research highlighted about the views of Islamic schools torrential, concerning the moment when a missing person is considered dead and therefore the devolution of his inheritance, as well as how to recovered it if he shows up alive on his wife, in exchange for surface legal texts do not meet for which they are intended.
