The article deals with the powers possessed by an emergency administrative judge in order the procedure which he sees necessary to protect fundamental freedom.

this is the most important form of administrative urgency that is included in the civil and administrative procedures, according to which the judge of urgency can order all necessary measures to preserve the fundamental freedoms violated, when deciding on the application for a suspension of an administrative decision.

accordingly, the power of the order recognized for an administrative decision judge is an essential means of preventing any attack against fundamental freedom.

to ensure its effectiveness, the Algerian legislator has recognized a penalty for violations by administration of the order addressed to it by the judge, it specified the procedure to be taken, in which it admitted to the administrative judge the power to associate the order for a threatening fine.
