تعتبر ضمانات المحاكمة العادلة إحدى أهم الوسائل الموضوعة لحماية حقوق الإنسان ضمن منظومة القضاء الجنائي إذ تشكل درعا واقيا للمتهم و قد دفع الاهتمام الدولي المتزايد بها إلى توجه اغلب التشريعات على رأسها المشرع الجزائري إلى إدراجها ضمن قوانينها الداخلية بغية حفظها وضمان التزام رجال السلطة بها، و تجسيدها في مختلف القطاعات أهمها القطاع العسكري نظرا لما تتسم به القوانين العسكرية من خصوصية لاسيما إن الجريمة العسكرية تعمقت وتوسعت بتوسع و تطور الجيوش الحديثة.
فالهدف من هذه الدراسة هو توضيح هذه الضمانات سوءا المنصوص عليها في قانون القضاء الجزائري 18 / 14، أو قانون الإجراءات الجزائية.
