Contemporary criminal policy revolves around several axes, most notably individual rights and freedoms as they are constitutional values and the public interest as a common social goal.

therefore, the Algerian legislator has directed towards establishing a criminal and procedural political engineering based on the observance of balance and reconciliation between those rights and private freedoms and the sanctity of the public right.

in the public lawsuit, and the first was consecrated in a constitutional pillar known as the presumption of innocence, he ensured the fulfillment of this presumption by providing a set of guarantees for the suspect or accused through the various criminal follow-up stations.

as this study aims mainly to trace the features of contemporary criminal policy in support of the presumption of innocence through the various stages and phases of the criminal case, and perhaps the most prominent results reached in this paper, that the procedural criminal scheme has disclosed its contemporary orientation regarding the principle of the presumption of innocence as a balanced preventive approach.
