There is no doubt that abortion, before it was just a physical fact that violates the law, is a very dangerous and complex social phenomenon because it affects the sanctity of the right to life.

Many legislations across the world, and in order to become familiar with the position of the Algerian legislator, we tried through this study to know the position of the Algerian legislator from this legislative dispute, by investigating the criminal and punitive policy that he pursued towards this phenomenon, by addressing the rules of establishing criminal responsibility for the act of abortion, and the reasons for its permissibility.
