Arabic Abstract

تناولت هذه الدراسة مفهوم السائح وأبرز الحقوق التي يتمتع بها في البلد المضيف، ودور الدولة في حمايته، وأثر قيام مسؤولية الدولة عن حمايته.

وقد خرجت الدراسة بنتائج كثيرة، من أهمها : يحصل السائح على حقوقه القانونية الكاملة في البلد المضيف استنادا إلى المواثيق الدولية والقوانين المحلية والدولية التي بينت هذا الحقِّ وحفظته له، ومن أهم التوصيات التي خرجت بها الدراسة: تسهيل إجراءات السفر والإقامة والمغادرة وتأمين السياح (تأمين صحي)، من خلال شركات السياحة، أو أن تقوم الدولة بذلك من خلال وزارة السياحة، فهذا يشجع السياح، ويؤكد، كذلك دور الدولة بالقيام بمسؤوليتها في مجال حماية السياح.

English Abstract

This study addressed the concept of tourist and the most prominent rights that tourists enjoy in the hospitable country, the role of the state in protecting tourists as well as the impact of the state's liability of protecting tourists.

The study concluded with several results, including that the tourist should gain his complete legal rights in the hospitable country in accordance with the international codes as well as the national and international laws that demonstrated and maintained this right.

In the light of the results, the study recommended the necessity of facilitating the procedures of traveling, arrival and departure, in addition to insuring them with health insurance through tourism companies or the state, represented by the ministry of tourism, since this encourages tourists and promotes the role of the state in the domain of protecting tourists.
