Abstract EN

This study aims to clarify the legal concept of human dignity and the role of the judiciary in protecting it from violation of the state authorities or individuals, by identifying its content, which is influenced by the legal and political system in each state.

The study also aims at clarifying the main applications of the laws in France and Jordan throughout relevant legislation and court decisions.The problem of the study lies in the concept of dignity which is in itself vacuous and undefined; so it appears in various forms and is used as a criterion for resolving the confliction in constitutional values, a principle to protect individuals and limit their freedoms as it is one of the goals of administrative control.

The human dignity is not directly protected by the Jordanian judiciary as it is in the French judiciary.

The study recommends the necessity of informing judges about this vital subject, which is considered today as the main focus of the state of law.
