On 29 November 2012, the UN recognized Palestine as a non-member observer state.

Following its recognition, Palestine acceded to several international human rights treaties, triggering both international and domestic obligations.

The examination of Palestine’s level of adherence to its domestic obligations has been the subject of long-standing controversy, particularly in light of the various constitutional sources governing the Palestinian legal system.

Such sources lack explicit reference to the status of international treaties in the Palestinian domestic system.

On the other hand, the Supreme Constitutional Court presented different positions to illustrate such status in its relevant decisions.

Hence, this study examines the accomplishments and shortcomings deriving from Palestine’s accession to several international human rights treaties, particularly the Convention on the Elimination of all forms of Discrimination Against Women (CEDAW), and the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (CAT), in addition to its Optional Protocol to the Convention Against Torture (OPCAT).
