Arabic Abstract

تناولت هذه الدراسة بيان المُستَجَدَّات الفقهية المُتَعَلِّقَة بالرضاع وأحكامه بين الفقه الإسلامي و قانون الأحوال الشخصية الأردني (2019م) ؛ لشدة الحاجة إلى بيان ما يتعلق بأمور الرضاع، لما يترتب عليه من الحُرمة وحفظ الأنساب من الاختلاط المحرم.

و قد خلصت الدراسة إلى إن الرضاع المحرم هو ما كان ضمن الحولين، و علة التحريم فيه إنما يكون من المجاعة، و يتحقق فيه إنبات اللحم و إنشاز العظم، و عليه فلا عبرة برضاع الكبير في التحريم ، و إنّه يُباح استئجار المرضعة، و لا يجوز بيع لبن المرأة الحُرَّة، و إن الأم تُجبر على إرضاع ولدها ولا تستحق الأجر عليه ما دامت في عصمة الزوج، و إن استعمال الوسائل في إدرار اللبن للإرضاع مباح ما لم يكن فيه ضرر على المرأة الثيب ؛ فهو يُعتبر من قبيل التداوي، أما غيرها ممن لم يسبق لها الزواج، أو عقيم، فلا يثبت بهذا اللبن الحُرمة بالرضاع، و يجوز للأم المصابة بفايروس كورونا كوفيد -19 إرضاع طفلها مع الأخذ بالتدابير الوقائية لأن لبن الأم لا ينقل العدوى الرضيع، و يجوز استخدام الحليب الصناعي في الرضاعة و لا تأثم الأم على ذلك في حالة الضرورة و في غير ذلك يوقف على تراضي الوالدين، و إن بنوك اللبن أمرٌ محرم شرعًا؛ لما يترتب عليه من اختلاط الأنساب.

English Abstract

This study dealt with clarifying the jurisprudential developments related to breastfeeding and its provisions between Islamic jurisprudence and the Jordanian Personal Status Law (2019AD).

The severity of the need to explain what is related to breastfeeding, because of the sanctity that it entails and preserving lineages from forbidden mixing.

The study reached some results, the most important of which are: forbidden breastfeeding is what was within the two years, and the reason for the prohibition in it is from starvation.

In it, the germination of meat and the formation of the bone is achieved, and accordingly there is no point in adult breastfeeding that it is forbidden.

It is permissible to hire a nursing woman, and it is not permissible to sell the milk of a free woman.

The mother is forced to breastfeed her son and she is not entitled to a reward for it as long as she remains within the protection of the husband, and the use of means to generate milk for breastfeeding is permissible as long as it does not harm the veiled woman.

A mother infected with Coronavirus Covid-19 may breastfeed her child while taking preventive measures because breast milk does not transmit the infection to the infant.

It is permissible to use formula for breastfeeding and the mother is not sinning for that in case of necessity, and otherwise it depends on the consent of the parents.
