Abstract EN

This study presents the illegal use of credit cards in the viewof the criminal law, which is based on the legitimacy principle.

The judge cannot criminalize facts or apply penalties not provided by the law due to the absence of a special text according to the criminal legal principle that says: `` No crime and no punishment except with a text ''.

Therefore, the judiciary faced great difficulties in order to find the appropriate adaptation for cases of assault on credit cards based on the penal code texts.

As result, the Algerian penal code texts related to money assault crimes do not provide adequate protection for the interests associated with the use of these cards.

For this reason, the legislator should intervene to fill this legislative void
