مر منح استغلال العقار الصناعي الموجه للاستثمار في الجزائر بالعديد من الطرق، كان أبرزها المنح عن طريق المزاد العلني المنتهي بالتنازل، لكنه بعد صدور قانون المالية التكميلي لسنة 2011، تم اعتماد التراضي كطريق وحيدة لمنح استغلال العقار الصناعي الموجه للاستثمار.
و في هذا الإطار خول التشريع الجزائري سلطة منح استغلال العقار الصناعي الموجه للاستثمار بصفة عامة حصريا للوالي المختص إقليما، و هذا وفق إجراءات قانونية خاصة بمشاركة الجهات المعنية ذات العلاقة بمجال الاستثمار بإعداد و تنفيذ العقد الإداري.
Abstract EN
The granting of industrial land to investors in Algeria has gone through several phases, the most important of which is the public auction, which ends with a waiver.
However, the complementary finance law of 2011 made it possible to adopt the amicableagreement as the only procedure.
In this context, Algerian law has conferred on the wali the main authority to conclude an administrative contract with the parties concerned, in accordance with legal procedures.
