Abstract AR
نص المؤسس الدستوري الجزائري على الحالات الاستثنائية التي يترتب عنها الخروج عن قواعد المشروعية العادية لمواجهة الظروف التي أدت إلى إعلان الحالات الاستثنائية، هذه الأخيرة تتمثل في حالة الحصار، حالة الطوارئ، الحالة الاستثنائية، حالة الحرب، وكلها حالات يتم إقرارها و الإعلان عنها من قبل رئيس الجمهورية.
يتعين على رئيس الجمهورية عند اللجوء حالة من الحالات الاستثنائية أن يتقيد بالضوابط الموضوعية و الشكلية المنصوص عليها في الدستور، لتفادي عدم دستورية إعلان الحالات الاستثنائية، و هذه القيود الشكلية والموضوعية وضعها المؤسس الدستوري لحماية الحريات و الحقوق التي يتم المساس بها عند إعلان هذه الحالات الاستثنائية.
Abstract EN
The text of the Algerian constitutional founder on the exceptional cases that result in deviating from the rules of normal legality to face the circumstances that led to the declaration of exceptional cases, the latter being the state of siege, the state of emergency, the state of exception, the state of war, all of which are cases that are approved and announced by the President of the Republic .
The President of the Republic, upon resorting to a case of exceptional cases, must adhere to the substantive and formal controls stipulated in the constitution, to avoid the unconstitutionality of declaring exceptional cases, and these formal and objective restrictions were set by the constitutional founder to protect the freedoms and rights that are violated when declaring these exceptional cases.

Le texte du fondateur constitutionnel algérien sur les cas exceptionnels qui conduisent à s'écarter des règles de légalité normale pour faire face aux circonstances ayant conduit à la déclaration de cas exceptionnels, ces derniers étant l'état de siège, l'état d'urgence, l'état d'exception, l'état de guerre, autant de cas approuvés et annoncés par le président de la République .
Le Président de la République, en recourant à un cas d'exception, doit respecter les contrôles de fond et formels prévus dans la constitution, pour éviter l'inconstitutionnalité de la déclaration de cas d'exception, et ces restrictions formelles et objectives ont été fixées par le fondateur constitutionnel pour protéger les libertés et droits violés lors de la déclaration de ces cas d'exception
