Abstract AR
يعالج هذا المقال دور المحكمة الجنائية الدولية و محكمة العدل الدولية في مجال الجرائم الدولية.
حيث أن اختصاص المحكمتين بنفس القضية و في نفس الوقت يطرح عدة تساؤلات.
تتمحور هذه التساؤلات حول مدى وحدة و تجانس الاجتهادات القضائية الصادرة منهما، و أيضا امكانية استفادة احدى المحكمتين من العمل القضائي للمحكمة الأخرى، و كذلك التعويض الذي يعتبر نقطة مشتركة بين المحكمتين.
كما تحدد الدراسة بدقة المحاسن المتوفرة للمحكمة الجنائية الدولية خلافا لمحكمة العدل الدولية، مثل الميزانية و عدد القضاة و نظم مراجعة الأحكام و مشاركة الضحايا في الاجراءات و التعويض المباشر للضحايا و أخيرا الاختصاص الموضوعي.
كما ختم المقال بالمحاسن المتاحة لمحكمة العدل الدولية خلافا للمحكمة الجنائية الدولية، مثل التحرر من صلاحيات مجلس الأمن، و امكانية أمر المحكمة بتدابير استعجالية و سرعة الاجراءات.
Abstract EN
This article discusses the role of the ICC and the ICJ in the area of international crimes.
The jurisdiction of the two courts over the same case and at the same time raises several issues.
These questions revolve around the unity and harmonization of the jurisprudence that they pronounce it, as well as the possibility for one of the two courts to benefit from the judicial work of the other court, as well as the compensation as the common point between the two courts.
The study identifies precisely the advantages available to the International Criminal Court unlike the International Court of Justice, such as the budget, the number of judges, systems for reviewing judgments, the participation of victims in proceedings, direct compensation for victims and finally jurisdiction.
The article concluded with the advantages available to the International Court of Justice unlike the International Criminal Court, such as the freedom vis-à-vis the Security Council, the possibility of the Court to order urgent measures and the speed of the procedures.
Abstract FRE
Cet article traite le rôle de la CPI et de la CIJ dans le domaine des crimes internationaux.
La compétence des deux juridictions sur la même affaire et en même temps soulève plusieurs problématiques.
Ces questions tournent autour de l’unité et de l’harmonisation des jurisprudences qu'elles les prononcent, ainsi que de la possibilité pour l'un des deux tribunaux de bénéficier du travail judiciaire de l'autre tribunal, ainsi que la réparation comme le point commun entre les deux tribunaux.
L'étude identifie précisément les avantages dont dispose la Cour pénale internationale contrairement à la Cour Internationale de Justice, tels que le budget, le nombre de juges, les systèmes de révision des jugements, la participation des victimes aux procédures, l'indemnisation directe des victimes et enfin la compétence.
L'article a conclu avec les avantages dont dispose la Cour Internationale de Justice contrairement à la Cour Pénale Internationale, tels que la liberté vis-à-vis du Conseil de sécurité, la possibilité de la Cour d'ordonner des mesures urgentes et la rapidité des procédures.
