تهدف هذه الدراسة إلى تجلية بعض مظاهر فقه التيسير عند الإمام مالك و الوقوف عند آليات تصريفه و آفاقه من خلال المسائل الفقهية في الموطأ، و ذلك باستقراء المادة الفقهية و تحليلها قصد استخلاص نتائجَ يمكن استثمارها في ترشيد الفعل الاجتهادي المعاصر، و قد آل البحث إلى جملة من الخلاصات منها : أن الإمام مالكا استمد منهجه الفقهي من روح الشريعة الإسلامية التي تروم جلب مصالح المكلفين و دفع المشقة غير المعتادة عنهم، إضافة إلى أن ضوابط تصريف مفهوم التيسير في الشريعة الإسلامية تجعل المجتهد مؤطرا بقواعد الشرع و كلياته، بحيث لا يسوغ له بحال خرقها قصد طلب التيسير.
و قد أوصى الباحث بضرورة استثمار المادة المقاصدية الوفيرة المنبثة في الموطأ، و ذلك من خلال استقراء مستفيض لفتاوى الإمام مالك و مسائله الفقهية، في أفُق إثراء الدرس المقاصدي و تأصيل كثير من القضايا المرتبطة به.
Abstract EN
This study aims to clarify some aspects of the jurisprudence of facilitation according to Imam Malik through the jurisprudential issues in Al-Muwattae, by extrapolating the jurisprudential material and analyzing it in order to derive results that can be invested in contemporary ijtihad.
In addition to the regulations governing the interpretation of the concept of facilitation in Islamic law, the mujtahid is framed by the rules and colleges of Sharia.
The researcher recommended the necessity of investing the objective material in the Muwattae, by extrapolating the fatwas of Imam Malik jurisprudence, in the horizon of enriching the objective lesson and rooting many of the issues associated with it.
