This study examines the topic of awloyā' al-'aqd (contract guardians) in the words of the jurists and their premises regarding the meaning, sections, and implications of 'wilāyah' (guardianship); the difference between 'right' and 'guardianship'; who the contract guardians are; the guardianship of the grandfather and father over minors; the question of whether the grandfather and father are independent in their guardianship or joint; the question of whether that guardianship extends to after the virgin female reaches puberty In an independent or shared guardianship; guardianship over the mature virgin and the mature female who had lost her virginity legitimately; the criteria of the guardian; the guardianship of the ruler in marriage; and then the order of guardians.
