Abstract EN

Despite the qualitative development of the international criminal court in the international criminal justice system and all the various international legal systems, however it has faced a number of obstacles since its establishment.

this study came to highlight the most important factors that prevent the effectiveness of this court in enforcing its jurisdiction that is originally complementary to national criminal jurisdictions, both in terms of legal restrictions contained in the Rome statute and its texts that came in the service of certain international parties that expressed their fear of establishing this judicial body in its early stages, which knew how to protect itself from the follow-ups that could affect one of them, and it did so through the preamble of the Rome statute, or in terms of the selective policy of the security council through the powers of referral and postponement of the investigation and its intervention in the work of this body under the name of the right of veto.

Malgré le développement qualitatif de la cour pénale internationale dans le système de la justice pénale internationale et de tous les différents systèmes juridiques internationaux, elle a cependant rencontré un certain nombre d’obstacles depuis sa création.

cette étude vient mettre en évidence les facteurs les plus importants qui empêchent la cour d’exercer efficacement sa compétence, complémentaire, à sa création des juridictions pénales nationales, tant en ce qui concerne les restrictions juridiques contenues dans le statut de Rome que dans les textes venus au service de certaines parties internationales qui ont exprimé leur crainte on de cet organe.

en effet, le traité de Rome, par le biais du statut de Rome, ou en termes de politique sélective du conseil de sécurité par le pouvoir de renvoi et de report de l’enquête et de son intervention dans les travaux de cet organe au nom du droit de veto.
