The right of the state to regulate raises a kind of doubt about the measures that it can take in the field of environmental protection, as the goal of liberalizing and protecting investment is at the heart of internal investment laws and international agreements to encourage and protect investments, and this is in light of a situation where the freedom of investors should not be hampered by restrictions resulting from environmental measures, and therefore these measures would constitute, in the eyes of both the investor and the arbitral tribunals, an impediment to this freedom of investment, on the one hand, and on the other hand, the problem of adapting the regulatory role of the state is raised through arbitration disputes related to indirect expropriation that investors adopt as a protection mechanism in this field.

Le droit de l'État à réglementer soulève une sorte de doute sur les mesures qu'il peut prendre dans le domaine de la protection de l'environnement.

L'objectif de libéralisation et de protection des investissements est au coeur des lois internes sur les investissements et des accords internationaux pour encourager et protéger les investissements, ce à l’ombre d'une situation où la liberté des investisseurs ne devrait pas être entravée par des restrictions résultant de mesures environnementales.

Car ces mesures constitueraient, aux yeux, tant de l'investisseur que des tribunaux arbitraux, une entrave à cette liberté de l'investissement, d'une part, et d'autre part, le problème de l'adaptation du rôle régulateur de l'État se pose à travers les litiges arbitraux liés à l'expropriation indirecte que les investisseurs adoptent comme mécanisme de protection dans ce domaine.
