يحظى تسيير العقار الفلاحي التابع للأملاك الوطنية الخاصة في الجزائر باهتمام تشريعي خاص، إذ نظم المشرع الجزائري كيفية استغلاله، مكرسا لأجل ذلك أسلوب الامتياز.
و في سبيل تحقيق النجاعة من استغلال هذه الأراضي من طرف المستثمر صاحب الامتياز، و تسهيلا له للحصول على قروض مالية من أجل مباشرته للأنشطة الفلاحية و تطوير و تحديث مشروعه الفلاحي مكن له المشرع الجزائري رهن حق الامتياز لفائدة مؤسسات القرض كضمانة للدين المقترض.
و هذا كاستثناء يخرج عن القواعد العامة التي لا تجيز إلا رهن العقار أو الحق العيني الذي يكون مملوكا ملكية تامة لشخص له أهلية لتصرف.
تطرقت هذه الورقة إلى بيان كيفية رهن حق الامتياز الفلاحي كاستثناء يخرج عن القواعد العامة، ثم تناولت كيفية حجز هذا الحق العيني المتفرع عن الملكية، و بيعه قضائيا في حال عدم سداد الدين.
Abstract EN
The management of the agricultural real estate belonging to the private national properties in Algeria is receiving a special legislative attention.
as the Algerian legislator has organized how to exploit it, so he devoted concession as method for that.
in order to achieve efficiency to the exploitation of these lands by the concessionaire investor, and facilitate him to obtain financial loans, the legislator enabled him to mortgage the concession right as a guarantee to the borrowed debt.
this paper tackles how to mortgage the agricultural concession right, as an exception to the general rules.
then, it deals with how to seize this right and sell it through auctions, in case the debt was not paid.

La gestion des biens immobiliers agricoles, relevant du domaine privé nationale, fait l'objet, en Algérie, d'une attention législative particulière.
Le législateur a en effet organisé la forme de son exploitation, et a consacré la concession comme méthode.
Afin de rendre efficace l'exploitation de ces terres par l'investisseur concessionnaire et de lui faciliter l'obtention de crédits, le législateur lui a permis d'hypothéquer le droit de concession en garantie de la dette contractée.
Cette recherche aborde la façon d'hypothéquer le droit de concession agricole, à titre d'exception aux règles générales.
Elle traite, ensuite, de la façon de saisir ce droit et de le vendre aux enchères, au cas où la dette n'aurait pas été payée.
