The directive law for public institutions distinguishes between public bodies and public economic institutions.

the public authority is either administrative, or industrial and commercial, and the latter is distinguished from its administrative counterpart in that it can finance its exploitative burdens in whole or in part by selling commercial production carried out according to a pre-prepared tariff and a general conditions book that specifies the burdens and restrictions the authority, as well as the rights and powers associated with it, and, when necessary, the rights and duties of users in this way, a public institution of an industrial and commercial nature is a person of public law entrusted with the management of a public utility that is commercial in its relations with others.

otherwise, the administrative public body is subject to the same rules applicable to management and to the principle of specialization, so the financial and accounting system applied to management is applied to it.

this makes the public institution of an industrial and commercial nature the most appropriate model for delegations, in contrast to the practice of organizing delegations in the Algerian experience.
