Abstract EN

This study aims to examine the most important evolutions witnessed by the constitutional council in Mauritania, with a focus on analyzing the institutional and structural changes of the bodies that oversee the constitutionality of laws and decide on electoral disputes in accordance with the provisions of the successive constitutions in Mauritania up to the current constitution revised three times (years 2006-2012-2017).

this is based on an analysis of the constitutional and legal texts governing the mechanism for forming the constitutional council and its areas of competence.

this study also examined the most important techniques and methods used by the constitutional council when deciding on appeals against the results of parliamentary, presidential and referendum elections, by analyzing the most prominent decisions of the council.

through this analysis we can define the areas of the electoral process that the council considers to fall within the scope of its competence, and those that are not within its jurisdiction, and it allows also to distinguish issues that the council classifies as affecting the validity of the elections from other issues that do not affect the integrity of the electoral process..
